Central Saanich, BC — The Central Saanich Police Service confirms that a traffic-related charge against Corporal Phil DiBattista has been dismissed by the Provincial Court of British Columbia.
The charge stemmed from a May 21, 2024, on-duty incident in which a cyclist was struck by a marked Central Saanich Police vehicle on Wallace Drive.
As reported during court proceedings, the cyclist sustained injuries that required medical attention, though they were not deemed to meet the threshold of “serious harm” under the Police Act. The incident was investigated by the Independent Investigations Office of British Columbia (IIO), which subsequently referred the matter to the BC Prosecution Service for charge assessment.
A charge of driving without due care and attention under the Motor Vehicle Act was approved in May 2025 following that review.
After hearing the evidence, the Provincial Court dismissed the charge on May 11, 2026.
